Suit No. EACCU/33/2004 – Mr. Edward
Airiofolo Vs. Mrs. Vigilus Airiofolo
A case of a husband petition for Dissolution
of the marriage contracted under Estako Native Law and Custom sometime in
May, 1988 and an order directing the Respondent to quit and deliver up
possession of the apartment she occupies in the Petitioner’s house. Under
customary marriage in Nigeria, women have no rights to property acquired
during the marriage nor have inheritance rights. WRW seeks to challenge
this discrimination under our fundamental human rights provision in our
constitution the African Charter on Peoples and Human Rights.
Suit No. OR/ACC/601/M/2005- Mr. Uyiekpen
Ebohon and Anor. Vs. Mr. Omorogiuwa Ebohon and Anor.
The action was brought by a widow and son of
a marriage contracted under customary law and borders on devolution of a
family property of a deceased Bini man and a husband who died intestate and
who during his lifetime was subject to a Bini Customary law. Primogeniture
is the customary practice of the Binis, but the system is now being abused
to exclude other children, in this case, sons from also inheriting when the
deceased had more than one property.
